Spouse/Partner visa concessions on income requirements.

The Home Office has recently updated its Covid-19 advice guidance to visa applicants and has extended the loss of income concession up to 31 May 2021. If you lost income due to coronavirus before 31 May 2021, employment income will be considered if the income requirement was met for at least 6 months before the date the income was lost.

In addition to this, if the salary has been reduced as the result of being furloughed, the Home Office will take this into account as if the individual is earning 100% of the salary. For self-employed individuals, a loss of annual income due to coronavirus between 1 March 2020 and 31 May 2021 will usually be disregarded, along with the impact on employment income from the same period for future applications.

The Home Office may also decide the application without seeing certain specified documents if those cannot be obtained due to coronavirus. It is also likely that those documents may be asked to submit after the date of application. In relation to the English language test, it is possible to apply for an exemption if the test centre was closed or the applicant couldn't travel to it due to coronavirus.

Please get in touch with one of Immigration Lawyer to discuss more, if you are unsure of how to evidence loss of income, the minimum income requirement or claim exceptional circumstances to support your application. Our expert team can be contacted at 0330 058 3929.
